Two coal companies hope to loosen regulation.
The Supreme Court heard oral arguments this week regarding the extent of power that the Environmental Protection Agency (EPA) is able to use in both past and future energy regulations. Two coal companies and a group of states challenged a ruling that upheld limitations imposed by the two previous administrations to regulate pollution created by U.S. power plants. The Supreme Court’s decision may impact the environmental agency’s authority to address climate change.
“What your interpretation of the statute claims for EPA is not a technical matter,” Justice Samuel Alito told Solicitor General Elizabeth Prelogar. “It is not a question of how to reduce emissions from particular sources, but you are claiming that the interpretation gives you the authority to set industrial policy and energy policy.”
